Terms and Conditions of Payment,

Production, and Installation

1. Introduction

These Terms and Conditions govern the services provided by SignSeek ("We," "Us," "Our") to clients ("You," "Your"). By engaging our services, You agree to abide by these Terms and Conditions. This agreement complies with Australian Consumer Law (ACL), the Fair Trading Act (NSW), and the guidelines set by the Australian Sign and Graphics Association (ASGA).

2. Quotes & Orders

2.1 Quotations: Quotes are valid for 30 days unless stated otherwise. Prices are subject to material availability and market fluctuations.

2.2 Acceptance: Orders are confirmed upon written approval (email or signed quote) and receipt of the required deposit.

2.3 Modifications: Any changes after approval may incur additional costs and extend production timelines.

3. Payment Terms

3.1 Deposit: A 50% deposit is required before production begins.

3.2 Balance Payment: Full payment is required prior to delivery/installation unless otherwise agreed.

3.3 Late Payments: Overdue invoices incur a 10% late fee after 14 days. We reserve the right to suspend work until payment is received.

3.4 Payment Methods: We accept bank transfers, credit cards (fees may apply), and other approved methods.

4. Production & Installation

4.1 Design Approval: All artwork must be approved in writing. Once approved, changes may incur extra costs.

4.2 Production Timeframes: Standard production times are between 7-14 business days but may vary based on workload and material availability.

4.3 Site Readiness: The client must ensure the site is accessible for installation. Delays due to site inaccessibility will incur additional costs.

4.4 Permits & Compliance: Clients are responsible for obtaining necessary permits, council approvals, or landlord authorizations.

4.5 Risk & Responsibility: Once installed or collected, the responsibility for signage transfers to the client.

5. Warranties & Liability

5.1 Material Warranty: We provide a 12-month warranty on workmanship and materials, excluding damage from weather, misuse, or external impact.

5.2 Defects & Repairs: Any defects must be reported within 7 days of delivery/installation. We will assess and rectify any issues resulting from manufacturing faults.

5.3 Limitations of Liability: Our liability is limited to the cost of the signage service provided. We are not liable for indirect losses or damages arising from installation, third-party actions, or external conditions.

6. Cancellations & Refunds

6.1 Order Cancellations: If an order is cancelled after production begins, the client is liable for incurred costs. Deposits are non-refundable.

6.2 Refunds: Refunds are only issued for defective products where replacement or repair is not possible. Change-of-mind refunds are not available.

7. Intellectual Property & Usage

7.1 Design Ownership: All designs remain the intellectual property of SignSeek until full payment is received. Unpaid designs may not be used or reproduced.

7.2 Marketing Use: We reserve the right to use images of completed signage for marketing purposes unless otherwise agreed in writing.

8. Dispute Resolution

8.1 Negotiation: Disputes should be resolved amicably through discussion.

8.2 Mediation: If unresolved, disputes may be referred to mediation in accordance with NSW Fair Trading guidelines.

8.3 Legal Jurisdiction: These terms are governed by the laws of New South Wales, Australia.

9. Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, such as natural disasters, supplier disruptions, or government regulations.

10. Amendments

We reserve the right to update these Terms and Conditions at any time. The latest version will be available on our website.

11. Acceptance of Terms
